Terms and Conditions for Use of NOXCESS

1. General
These terms govern the use of NOXCESS (the “Service”), provided by NOXCESS AS (the “Company”).
By creating an account and using the Service, you agree to these terms in full.
2. The Service
NOXCESS is a membership-based digital service that provides users with priority access and benefits at selected nightlife venues and events.
The Service uses digital coins as a payment and access mechanism.
3. Membership
- Membership is personal, non-transferable, and may not be shared.
- Membership renews automatically on a monthly basis unless cancelled prior to the next billing period.
- Different membership tiers provide different rights and benefits.
- Membership benefits may vary by venue and over time.
4. Cancellation
Membership may be cancelled at any time through the app or via email.
Cancellation takes effect at the end of the current billing period.
No refunds are provided for unused time or coins.
5. Payment and Billing
Subscriptions and coin purchases are charged through approved payment solutions.
Payments are non-refundable unless otherwise required by mandatory law.
6. Coins – General
Coins are a digital unit with no monetary value outside NOXCESS.
Coins cannot be exchanged for cash, transferred to other users, or refunded.
7. Coins Included in Membership
Each membership tier may include a fixed number of coins per month.
Coins may have limited validity and may expire if not used within the specified period.
8. Purchase of Coins
Coins may be purchased separately within the app.
Pricing and packages are determined by the Company and are independent of membership tier.
9. Use of Coins
Coins may be used to bring guests or access higher levels than the user’s membership tier.
All coin usage is final and cannot be reversed.
10. Venues and Third Parties
Venues are independent third parties.
Final admission decisions are always made by the venue.
The Company is not responsible for capacity limitations, denied entry, or the on-site experience.
11. Age Requirements and Identification
Users must meet applicable age requirements and present valid identification upon request.
12. Misuse and Sanctions
Misuse of the Service, including but not limited to resale of access, abuse of coins, or attempts to circumvent venue rules, may result in temporary or permanent suspension, confiscation of coins, and termination of membership without refund.
13. Changes to the Service
The Company may change prices, functionality, membership benefits, and terms.
Material changes will be communicated within a reasonable time frame.
14. Force Majeure
The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to strikes, pandemics, government actions, or technical outages.
15. Limitation of Liability
The Company is not liable for indirect losses or circumstances beyond its control.
16. Privacy
Processing of personal data is governed by NOXCESS’ Privacy Policy.
17. Governing Law and Jurisdiction
These terms are governed by Norwegian law.
Disputes shall be settled by Norwegian courts.
